Nelnet must provide debt validation before taking any actionNelnet contacted me regarding a debt I owed. I was asked to pay the debt immediately without any delay or suffer the consequences.
I asked him for my address details and requested that he share the proof of debt validation.
The man disconnected the call, and he did not confirm that he would help me with these details.
After a few days, I called them again and asked for details about the debt.
They said they were not liable to provide me with any documentation and that I should think about when the payment will be made rather than arguing.
If you think I don’t know my rights, you treat me too lightly.
This is why I want to share this message with them:
I am the one you want to pay the debt to. You guys have to prove that I was given proof that the debt was taken.
This is not a request, but I have the right to be informed before paying the debt.
I require the information, and you are liable for providing it under 15 USC 1692g Sec. 809 (b) of the FDCPA.
I need proof to prove that I am legally obligated to pay the debt.
You cannot transfer the account to any significant credit bureaus or other credit bureaus while waiting for the proof to be validated.
Otherwise, you might be charged under federal and state law with fraud.
You could also be charged with fraud if you have any evidence of a negative credit score.
You could consult your legal team to get the same opinion. Once you have provided the proof, you still have 30 days for me to verify the legitimacy of the documents and decide whether the debt was correctly reported. You have no right to ruin my credit score until then.
If you cannot provide me with complete proof of the debt within the next 30 days, then the references must be removed from my credit file.
You should completely delete it as if you never had it. I want a copy to confirm that this was done and send it to my email.
Everything I have stated is by the law. If you don’t abide by these points, I will take legal action against you and your client.
Numerous scam cases have made people pay for the bad debt.
This has put me in a position to request such vital information before paying you.
You can either cooperate or forget about the debt, as I won’t be responsible for it.
