Lauren Hanley-Brady was finally hired by the founder of the McMillan Academy of Law who is headed by Scott McMillan San Diego Attorney, with The_McMillan_Law_Firm La Mesa, 4670 Nebo Drive, who was sued for fraud, see the lawsuit here.  Although the lawsuit against Michelle Volk San Diego Attorney, and Scott McMillan was asked to be dismiss, the judge denied it.

Only a few months ago in 2017, a 9th Circuit judge mockingly called a lawsuit filed by Scott McMillan La Mesa Attorney, a “Silly” lawsuit that lacked merit principle. The video clip of the judges comments can be found in this video clip, https://www.youtube.com/watch?v=OjCfjHgW-S0 So unfortunate to have the USA defend volumes of papers filed by The McMillan Law Firm La Mesa, only for the court to call the case “silly.”

Wasting judicial resources is concerning for me since courts have limited time to deal with meritorious cases. People who waste judicial resources are known as a vexatious litigant. In yet another case involving Scott McMillan, La Mesa, McMillan v. Weathersby (9th Cir. 2002) 31 F.App’x 371, 374, complained about one of his many losses. The Court discarded the argument of Scott McMillan and found that, “None of the three main episodes that McMillan offers supports granting a mistrial. McMillan first asserts that defense counsel violated the court’s in limine ruling barring reference to McMillan as a “vexatious litigant” by referring to McMillan’s other lawsuits in his opening statement.” McMillan LOST that case.

Recently a federal judge corrected the belief of Scott McMillan and ordered another one of his appeals to be dismissed. In Lycurgan, Inc. v. Todd JonesFiled (ATF Chief), Ninth Cir., Case No. 15-55228, SDCA Case No. 3:14-cv-01424, where it said, “Accordingly, we dismiss this appeal for lack of jurisdiction. DISMISSED.”

Despite the DOZENS of losses Scott McMillan has the audacity to fraudulently represent himself as a leading attorney in San Diego.  Literally he states he “IS” a leading attorney in the attached screenshot. I am unable to locate a SINGLE publication where Scott McMillan has received awards from Consumer Attorneys of San Diego, Lexis Publication, San Diego Daily Transcript, Los Angeles Lawyer, or SuperLawyers.com ranking Scott McMillan or his flunky firm as leading in any category – unless he’s ranked in loses, then Scott McMillan “IS” a leading attorney in that category.     Scott McMillan an attorney in San Diego, is the dean of the McMillan Academy of Law in La Mesa. The State of California recently filed reports noting in over a decade not a single student graduated!

    “We have had one student take the First Year Law Students’ Examination and that student passed. This is the basis for the 100% pass rate thus far. As of yet, no students have graduated from the Acad-emy.”

    Now it appears as though Scott McMillan may be into different type of fraud – operating a law school without any graduates and in fact doesn’t even have a sign saying a law school operates out of his small office in east San Diego by the railroad tracks. Recently the State Bar of California pointed out that in over a decade, Scott McMillan has not had a single graduate:

    “Since opening, only three students have ever completed MAOL’s first-year curriculum and were able to take the First Year Law Students’ Examination; two of the students eventually passed the examination but each then left MAOL and transferred to other law schools. Since MAOL has had no students nor has held any classes in almost five years, its program of legal education has now been dormant for more than four years. As a result, and as confirmed by the inspection, MAOL is noncompliant as to three material requirements: Its law library is noncompliant since its hardcopy legal authorities have not been updated since 2013; without any tuition income, the law school’s current and future financial viability appears questionable; and its website and written materials offer outdated and misleading information to both the general public and potential applicants.”

    Imagine having a law school and there isn’t even a sign on the building (google McMillan Academy of Law for building), no students, no graduates – now is this indicative of a fraudulent scheme?
