Horrible Experience

My experience with Capital Title was horrible. I would advise everyone and anyone to stay away.

Long story short- I was the seller, someone else was the buyer on a transaction that was supposed to close on a Friday.

My agent and I were working with title during the week of closing to make sure we had the appointment setup and no issues.

As of Wednesday afternoon, Capital Title went silent. So we continued to call and push and got no answer.

Finally, on Friday (the day of closing) after calling and emailing all day, I received a call at 4:40 p.m. from a guy named Sebastian (not the girl with whom I had been working).

Sebastian explained to me that he was a lawyer and owner and that I am in breach of contract because I didn’t close on this transaction.

He then stated that he would have a mobile notary sent out to my house on Friday evening to sign.

I told him I would wait for this mobile notary. He then went back and said we would have to close on Monday or Tuesday.

As it turns out, Sebastian is part of a wholesaling group and gets houses under contract and then assigns the contract to investors.

Not only did he fail to disclose this information to me as we asked numerous time, but he failed to put assignment language in the contract to be able to legally do so.

I explained to him that I would sue for specific performance under my contract if they didn’t close by Tuesday.

We ultimately closed on Tuesday and funded on Wednesday.

Sebastian never called and apologized or tried to make it right.

This company is not only negligence in their duties to their customers/client but shady as well.

I would never, ever do business with them or the “owner” Sebastian, and I would advise you to stay away as well.

I’m an attorney, so at least I know my options without consulting anyone; however, you may not be so lucky!

    Horrible experience as sellers…miscalculated our closing costs due to “computer glitch”, refused to provide any assistance due to their admitted error and when I filed a complaint with the BBB,

    they lied in their response, including that they sent us a gift card to help compensate us for the poor experience. Still waiting to hear back on the complaint I filed with CFPB…maybe they can get them to admit they screwed up. NEVER use this company!

    My friend just had a land deal which was closed at capital title. Her escrow officer was Samantha and she is very professional and helpful. She helped and updated us on each and every step and answered all our questions promptly.

    We are very happy with their service and would recommend them to everyone in realestate business that they add this title company to their places to close real-estate deals instead of going to a few big players who don’t have time for their customers and take days to pick up their phones!!!

  3. NOT Capital Title.

    There are a lot of great Title companies in Austin. Unfortunately, Capital Title is NOT one of them. Over 6 weeks since the closing and still no Title policy. I drove to their office after 3 weeks, and was told the absolute latest would be 6 weeks.

    Also told today that the division that writes them was already gone for the day ….at 4:30 ! Not even pre-weekend or holiday. So save yourself a lot of grief, and use one of the many good companies….NOT Capital Title.
