Felipa Richland, a California lawyer, lost a significant case in which the Superior Court awarded her and her client Kourosh Hakimpoor (aka Kenny Hakimpoor) an award.
She was made to resign from his California Corporation Nathan Enterprises Corporation.
Felipa Richland was found not to have merit in her appeals.
This was in the Court of Appeal Second District, Case Number 2216582.
“Thus NEC has not entitled the tolling provision of Section 351 because NEC has not established the necessary factual prerequisite for applying the statute,” the Court of Appeal stated.
Felipa Richland, Beverly Hills attorney, also argued that she failed to file the lawsuit within a prescribed time. According to the court,
“Because NEC did not file the underlying case by February 13, 2008, its malicious prosecution claim based upon the filing of [second] was time-barred, and the trial court correctly found NEC had no likelihood of prevailing on that claim.” But Felipa Richland still filed the lawsuit.
The Court of Appeal ruled that Felipa Richland’s argument should be discarded.
Accordingly, NEC does not have a chance of winning on its abuse-of-process claim.
The anti-SLAPP statute must also be struck down as the second cause of action for abuses of process claims arising from protected activity that lacks even minimal merit.
Now let us look at the other causes of action.
Last but not least, Felipa Richland’s argument was discarded by the Court of Appeal, which stated that “NEC does not have the standing to bring claims for intentional or negligent infliction of distress emotional.”
It is possible that Felipa Richland, a California attorney, consulted with Scott McMillan, a San Diego attorney who was described as a litigant who was vexatious in other cases.
